1 - Principe
L'argent a ete concu comme un outil pour ameliorer les echanges entres
les hommes. En effet, avant la creation de l'argent, les echanges
etaient limites au simple troc. La creation de l'argent a permis
d'etendre largement les echanges. Mais aujourd'hui, les echanges entre
les hommes sont limites car ils n'ont pas assez d'argent pour acheter
tout ce dont ils ont besoin, creant marasme economique et chomage.
Money was conceived as a tool to improve exchanges between men.
In effect, before the creation of money, exchanges were limited to
simple barter. The creation of money permitted an expansion of
exchanges. But today, exchanges between men are limited because they
don't have enough money to buy all they need, creating stagnation and
unemployment.
Pourquoi n'y a-t-il pas assez d'argent? En fait, il n'y a jamais eu
autant d'argent qu'aujourd'hui, mais il ne sert plus prioritairement
aux echanges entres les hommes. En effet, l'argent sert a gagner de
l'argent en speculant (comme avec les assurances-vie qui se
developpent rapidement depuis quelques annees), et donc il circule
dans les circuits financiers de la speculation (95% de l'argent sert
au circuit speculatif, 5% seulement servirait au commerce).
Why isn't there enough money? In fact, there was never as much
money as there is today but it doesn't serve principally for exchanges
between men. In fact, money gains money by speculating (like life-
insurance which has developed rapidly in recent years), and therefore
it circulates in financial speculation circuits (95% of money is in
the speculative circuit, only 5% serves for commerce).
JCT: Que tant d'argent est dans le circuit financier n'est pas
la vraie cause du manque. Meme s'il n'y avait pas d'argent qui a ete
emprunte en circulation comme principal dans le circuit financier, il
manquerait toujours l'argent pour payer l'interet qui n'a jamais ete
cree.
JCT: That so much money is used in financial speculation is not
the true cause of the lack. Even if none of the money borrowed into
circulation as principal were in the financial circuit, there would
always be the lack to pay the interest which was never created.
Autre cause du manque d'argent: les gens ont peur de l'avenir, donc
ils sont plus prudents dans leurs depenses et moderent leurs achats,
ralentissant ainsi la vitesses de circulation de l'argent (le fait de
retarder tous les mois de 3 jours ses achats, ralentit de 10% la
vitesses de circulation de l'argent et donc diminue de 10% les
transactions totales effectues).
Another reason for the lack of money: people are worried about
the future so they're cautious in their spending and buy less, slowing
down the speed of money's circulation (delaying one's purchases by 3
days every month slows down the speed of circulation of money by 10%
and reduces by 10% the total transactions made).
JCT: La velocite des echanges ne peut pas etre la cause du
manque.
JCT: Velocity of exchanges cannot be the cause of the lack.
De plus les banques qui gerent l'argent le font dans leur propre
interet (gagner de l'argent) et pas dans l'interet des hommes (tres
peu de banques pretent aux personnes qui veulent creer leur emploi,
les obligeant a passer par la collecte directe de l'argent d'amis). De
nombreuses personnes disposent de temps de libre (surtout avec le
chomage actuel!) ou de productions excedentaires qu'elles ne peuvent
vendre car il n'y a pas d'argent pour les remunerer.
Also, the banks which manage money do it in their own interest
(gaining money) and not in the interest of men (very few banks lend to
people who wish to create their own job, forcing them to directly
obtain the money from friends). Many people have free time (especially
with the ongoing unemployment!) or surplus production they can't sell
because there's no money they can earn.
JCT: Il y a donc un manque d'argent et non de velocite.
JCT: There is therefore a lack of money, not of velocity.
Il y a des marchandises ou des personnes disponibles pour travailler,
et aussi des acheteurs potentiels pour ces services et ces
marchandises, mais il manque l'outil necessaire (l'argent) pour que
ces transactions s'effectuent. Comme aujourd'hui l'argent ne joue plus
son role vital de vecteur des transactions entre les hommes, il est
urgent de creer un nouveau systeme permettant les transactions sous
peine d'etouffement.
There are goods and people available to work and also potential
buyers for these goods and services but they lack the necessary tool
(money) to permit these transactions. Because today, money does not
play its vital role as vector of transactions between men, it's urgent
to create a new system to permit these transactions or we'll
suffocate.
NAISSANCE DU LETS:
BIRTH OF LETS:
C'est ainsi que Michael Linton, Ecossais residant dans l'Ile de
Vancouver au Canada imagina le LETSysteme (Local Exchange and Trading
System - Systeme d'Echange et de Commerce Local), afin d'aider les
nombreuses personnes au chomage dans cette region et souvent douees
d'un savoir-faire tres utile pour tous. Ce systeme traduit en France
par "Systeme d'Echange Local" ou SEL, s'est developpe au Canada, aux
Etats Unis, et en Grande-Bretagne (plus de 200 groups dans ce pays),
permettant, dans les regions en crise, aux personnes utilisant ce
principe de vivre normalement.
That's why Michael Linton, Scotsman residing on the Island of
Vancouver in Canada thought of the LETSystem (Local Exchange and
Trading System) to help the many people on unemployment of the region
who often possessed know-how useful to all. This system translates in
French as System of Exchanges Local or SEL and developed in Canada,
the United States and in Great Britain (more than 200 in that
country), allowing people in these regions in crisis who use this
principle to live normally.
D'autres systemes ont deja fonctionne avec succes:
- Worgl en Autriche en 1932-33, ville de 5000 habitants avec 1500
chomeurs, le maire cree une "monnaie franche": au bout de 9 mois, il
n'y a plus de chomeurs, de nombreux equipements sont construits, tout
va pour le mieux sauf pour la Banque Nationale qui n'est pas d'accord.
L'experience s'arrete et les problemes reapparaissent;
- A Lignieres en Berry en 56-57 et Marans en Charente Maritime en 57-
58, la meme chose s'est produite, le fisc est intervenu pour stopper
ces reussites.
Other systems have already worked successfully:
- Worgl in Austria in 1932-33, a town of 5000 inhabitants with
1500 unemployed, the mayor created an "honest money": at the end of 9
months, there are no more unemployed, many new projects are built, all
is going great except for the National Bank which does not agree. The
experiment is stopped and the problems reappear;
- At Lignieres en Berry in 56-57 and Marans en Charente Maritime
in 57-58, the same thing happened, but the tax-man intervened to stop
these successes.
JCT: Je pense que ca demontre clairement qu'il y a une
conspirationi de banquiers pour garder les gens en chomage au benefice
des banquiers.
JCT: I think this clearly shows that there is a conspiracy of
bankers to keep people unemployed to the bankers' benefit.
On peut se poser la question de la legalite du Systeme d'Echange
Local. Se poser cette question, c'est rentrer dans le jeu de ceux qui
ont fait les lois dans leur interet (en particulier les banquiers et
les financiers). Il faut plutot se poser la question "Que nous dit
notre conscience? Faut-il se laisser deperir car nous n'avons pas les
moyens d'acheter ce dont nous avons besoin, ou faut-il vivre
pleinement en creant les moyens pour respirer mieux, pour faire
circuler l'energie entre les hommes?" Actuellement, les Systemes
d'Echange Locaux sont toleres car les etats ne savent pas resoudre les
problemes du systeme economique, et ils peuvent aider a desamorcer des
violences qui inevitablement vont se produire dans le futur.
We can ask the question of the legality of the Local Exchange
System. Asking oneself this question is playing the game of those who
got the laws in their favor (bankers and financiers in particular). We
must actually ask the question: "What does our conscience say? Must we
let ourselves waste away because we do not have the means to buy what
we need, or should we live a fuller life by creating the means to
better breathe, to better circulate the energy between men?" Actually,
Local Exchange Systems are tolerated because states don't know how to
resolve the problems of the economic system, and they can help defuse
the violence which will inevitably arise in the future.
LES AVANTAGES DU SEL:
THE ADVANTAGES OF LETS:
Ce systeme permet toujours a la monnaie de circuler et aux gens d'en
avoir assez pour payer leurs impots, electrique, telephone, eau, et
tous les objets manufactures. Ce systeme degage finalement plus
d'argent pour les echanges nationaux (en particulier pour les taxes et
impots), donc chacun s'y retrouve. Ce sont les productions locales qui
vont etre favorisees par ce systeme, evitant les importations
lointaines et l'exploitation du tiers-monde, en faisant travailler les
personnes les plus proches de chez nous. Ainsi les agriculteurs ou les
artisans ne craignent plus les concurrences deloyales.
This system allows money to always circulate and for people to
have enough to pay their taxes, electricity, telephone, water and all
manufactured goods. The system finally liberates more money for
national exchanges (for taxes and duties in particular) which
everybody needs. Local production is preferred with this system,
avoiding imports from afar and the exploitation of the Third-World, by
getting people the closest to us to do the work. Thus, farmers or
artisans don't have to worry about disloyal competition.
Ce reseau est tres interessant pour les personnes travaillant a mi-
temps, ayant assez d'argent pour payer la part obligatoire en francs,
le SEL permettant d'apporter la part complementaire. Dans le cadre
economique actuel, il serait possible de faire disparaitre tous les
chomeurs (plus de cinq millions de chomeurs, CES, RMI, stages
divers...) en transformant de nombreux emplois a plain temps en
emplois a mi-temps avec complement en SEL (quatre millions d'emplois a
plein temps transformes en huit millions d'emplois a mi-temps). Pour
l'Etat, les economies seraient considerables, sur les indemnites
chomage, de preretraite, de RMI, de CES..., et sur tous les stages de
formations qui servent a cacher la misere, sans compter l'amelioration
des situations psychologiques (plus de chomeurs depressifs) diminuant
les frais medicaux, les violences, les trafics de drogues... Ce serait
l'economie informelle au secours de l'economie institutionelle.
This network is very interesting to people working part-time,
having enough money to pay the obligatory part in francs with the LETS
permitting payment of the other part. In the actual economic
framework, it would be possible to make all the unemployment disappear
(more than five million unemployed, CES, RMI, different training
courses...) by transforming many full-time jobs into part-time jobs
with the remainder in LETS (four million full-time jobs transformed
into eight million part-time jobs). For the state, the savings would
be considerable on unemployment payments, early retirements, of RMI,
of CES..., and on all types of training programs which serve to hide
the misery, without counting the betterment of psychological
situations (no more depressed unemployed) reducing medical costs,
violence, drug trafficking... This would be the informal economy to
the rescue of the institutional economy.
JCT: Forcer les gens a travailler a demi-temps pour l'argent
federal et a demi-temps pour l'argent local n'est pas la solution
optimale. Reparer le systeme d'argent federal pourque ca opere comme
de l'argent local, sans interet, est la solution optimale.
JCT: Making everyone work half-time for federal cash and half-
time for LETS cash is not the optimal solution. Fixing the federal
cash system to operate like the LETS cash system, interest-free, is
the optimal solution.
En France, l'Etat considere le SEL comme du travail noir et donc ne
ceut pas le favoriser. Certains pays comme la Nouvelle-Zelande et
L'Australie reconnaissent deja l'interet des reseaux SEL pour
permettre aux chomeurs de rester en contact avec le marche du travail,
de ne pas entrer dans le circuit de l'assistanat et de maintenir des
liens sociaux qui evitent la descente vers l'isolement et la
marginalisation. La creation des SEL peut permettre aux hommes de
continuer a vivre, meme si l'economie mondiale s'ecroule comme le
montrent les soubresauts de plus en plus importants des bourses et des
monnaies.
In France, the state considers LETS as black-market work and
therefore doesn't want to support it. Certain countries like New
Zealand and Australia already recognize the value of LETS networks to
allow the unemployed to stay in contact with the job market, to avoid
depending on public assistance, and to maintain social links which
help avoid the descent into isolation and marginalization. The
creation of LETS can allow men to continue to live, even if the world
economy crashes demonstrated by the bigger and bigger jolts of the
stock and money markets.
JCT: C'est interessant que le gouvernement francais defavorise le
SEL pendant que la Communaute Europeenne le favorise pendant que la
France en fait partie.
JCT: It is an interesting situation where the French government
frowns on LETS as black-market work while LETSystems are being
supported by the European Community of which France is a part.
2 - FONCTIONNEMENT
2 - OPERATION
a - La zone geographique:
Pour que les SEL puissent fonctionner, il faut que les gens ne soient
pas trop eloignes pour que les personnes puissent se deplacer
facilement les unes chez les autres pour effectuer les echanges. Cela
peut etre une grande ville, un departement ou une partie de
departement.
a - The geographic zone:
So LETS can work, people must not be too far away from each other
so they can easily get around to do their exchanges. It can be a large
city, a province or a part of a a province.
JCT: Il n'y a pas de raison que les gens soient pas trop eloignes
les uns des autres. L'avenement des echanges d'accomodations est assez
bonne preuve que le success du SEL n'a rien a faire avec la zone
geographique.
JCT: There is need for traders to be in close proximity. The
advent of trading of accommodations is pretty good proof that its
success has nothing to do with the geographic zone.
b - Le choix de l'unite d'echange:
Pour plusieurs groupes, l'unite de compte des le "Grain de sel" qui
par commodite a une valeur actuelle de 1 FR. D'autres unites peuvent
etre choisies comme le "Gland" ou "l'heure de travail", mais
actuellement s'etudie la possibilite d'avoir des echanges entre les
groups utilisent la meme unite comptable, les echanges seront plus
faciles. Pour comptabiliser l'heure de travail, il est conseille de
prendre une base de 50 Grains de Sel par heure. Il n'y a pas de bareme
impose, toutes les transactions donnent lieu a des negociations sur
les valeurs des services ou des objets echanges. Avantage du SEL, si
un jour ou l'autre la monnaie nationale s'ecroule suite a la
speculation des financiers, le systeme SEL permet toujours aux
personnes d'echanger meme si l'economie officielle est dans le marasme
noir.
b - The choice of unit of exchange:
For several groups, the accounting units are "Grains of Salt"
which have an actual value of 1 Franc. Other units can be chosen like
the "Gland" or "Hour of work", but there is now the study of the
possibility of having exchanges between the same accounting unit, the
exchanges will be easier. To account for the hour of work, it is
advisable to use a base of 50 Grains of Salt per hour. There is no
specific scale imposed, all transactions give rise to negotiations on
the value of goods and services exchanged. The advantage of LETS, if
one day or other the national money crashes due to financial
speculation, the LETSystem allows people to continue trading even if
the official economy is in black stagnation.
c - L'etablissement d'un annuaire des membres:
Le SEL ne peut bien fonctionner que si chacun connait les offres et
les demandes des autres membres du reseau. Il est donc etabli
regulierement un annuaire recensant toutes les offres et les demandes,
les competences, le materiel disponible, l'etat des comptes... L'etat
des comptes ouvert a tous, permet de donner priorite pour le travail a
ceux qui sont en negatif, et d'eviter de trop grosses transactions
avec ceux qui sont trop en negatif. Toutefois, il est necessaire
d'avoir des comptes en negatif pour fair tourner le systeme.
L'endettement n'est pas penalise et montre que l'on effectue des
transactions, c'est le moteur du systeme. Par contre les personnes qui
ont beaucoup de positif et qui ne l'utilisent pas vont bloquer le
systeme. Ce systeme est justement cree pour que l'energie circule,
donc gare aux comportements de thesaurisation qui tuent deja le system
economique officiel.
c - Establishing a directory of members:
LETS can only work well when everyone knows the offers and wants
of the other members in the network. So a regular directory is needed
with all the offers and requests, the skills, the available materials,
statements of accounts... The statement of accounts is open to all to
allow work priority given to those who are in the negative and to
avoid too large transactions with those who are too negative.
Nevertheless, it is necessary to have some accounts in the negative to
make the system work. Getting in debt isn't penalized and shows that
we're participating in transactions, it's the motor of the system.
Similarly, those who are greatly in the positive and who don't use it
can block up the system. The system is specifically designed so the
energy can circulate, so beware of similar attitudes that are already
killing the official economic system.
JCT: Dans le systeme SEL des Heures d'Ithaca, personne est dans
le negatif et sa fonctionne encore, meme avec plus de succes que
d'autres systemes. Donc c'est seulement les systemes qui sont geres
pourque les comptes personnelles negatives balancent les comptes
personnelles positives ou ce probleme se trouve. J'ai offert deux
solutions a cette marasme, soit un magazin et l'invitation aux
pensionnes de participer.
JCT: In the Ithaca LETS Hours system, no one is in the negative
and it still works, more successfully than most. So it is only if you
operate your system so that negative personal accounts balance
positive personal accounts that you have this problem. I have offered
two solutions to this stagnation such as LETS consignment stores and
getting pensioners to participate.
d - L'enregistrement des echanges:
Chaque membre du systeme dispose de bons d'echanges qu'il envoie,
apres transaction, a la personne chargee des enregistrements des
transactions. Ces transactions sont enregistrees avec un programme
informatique adapte aux SEL, permettant regulierement l'edition des
comptes des transactions et de les distribuer a tous les membres.
Certains echanges peuvent s'effectuer pour moitie en "Grains de Sel"
et pour moitie en francs (par exemple) lorsque le produit vendu est
fabrique avec des matieres premieres achetees en francs, car l'artisan
doit pouvoir les payer lorsqu'elles viennent du circuit classique.
Dans ce cas la, seuls les Grains de Sel seront enregistres, les
transactions en francs n'interessent pas le groupe.
d - Registration of exchanges:
Each member of the system uses exchange checks which each sends
after the transaction to the person in charge of registrations of
transactions. These transactions are registered with a software
program adapted for LETS, permitting regular compilation of accounts
and distribution to all members. Some transactions can be made half in
"Grains of Salt" and half in francs (for example) when the product
sold is made with raw materials bought with francs so the maker can
pay for them when they come from the orthodox circuit. In this case,
only the Grains of Salt are registered while the transactions in
francs are of no interest to the group.
JCT: Enregistrer toutes les transactions nous donne un systeme de
velocite 1 which souffre des problemes qui n'existent pas dans les
systemes de haute-velocity comme celui d'Ithaca et d'autres systemes
bases sur l'argent local en papier.
JCT: Of course, registering all transactions is a 1-velocity
system which has many problems not existing in high-velocity systems
such as Ithaca and other paper-based local currency systems.
e - Les frais de fonctionnement:
Pour payer les frais de fonctionnement du SEL (telephone, timbres,
photocopies...) une cotisation annuelle est demandee, generalement de
100F et certains SEL ont ajoute une cotisation de 150 grains de sel
pour indemniser les personnes gerant le SEL.
e - Operation costs:
To pay for the costs of the LETS operation (telephone, stamps,
photocopies...) an annual fee is requested, generally of 100 francs
and some LETS have added a fee of 150 Grains of Salt to pay the
people operating the LETS.
f - Les "marches tout en grains":
Certains groupes SEL organisent regulierement des marches reunissant
tous les membres du groupe et ou toutes les transactions s'effectuent
en "grains de sel". Ces marches sont tres utiles pour permettre aux
membres du reseau de faire connaissance et de permettre, outre des
echanges de produits, d'echanger des informations et de creer des
liens qui vont favoriser les echanges futurs.
f - Markets completely in Grains:
Some LETS groups organize regular markets for all the members of
the group and doing all transactions in "Grains of Salt." These
markets are very useful to allow members of the network to know and to
permit, other than the exchange of products, the exchange of
information and to create links which will favor future exchanges.
g - La fiscalite et les assurances:
Normalement toutes les transactions sont passibles de la TVA. Pour les
echanges en "grains de sel", la TVA devrait etre payee en "grains de
sel". Une personne a rempli deux declarations d'impot, une pour les
travaux en francs et une en grains de sel. A suivre. Pour les
personnes effectuant des travaux chez d'autres personnes, elles
doivent avoir un statut et une assurance. Des etudes sont en cours
pour trouver les meilleurs solutions.
g - Taxation and insurance:
Normally, all transactions are taxable. For exchanges in Grains
of Salt, the tax must be paid in "grains of sel." One person filled
out two tax declarations, one for the work in francs and one in grains
of salt. More to come. For people doing work for other people, they
have to have status and insurance. Studies are now being done to find
the best solutions.
h - La coordination des SEL:
Afin de resoudre les problemes qui se posent aux SEL, une coordination
nationale se reunit regulierement. Des informations sur les groupes
etrangers sont aussi echangees. La coordination a egalement pour but
d'aider toutes les personnes qui veulent creer des SEL. A lire le
numero 210 de "Silence" de novembre 1996, un dossier sur le SEL avec
les points de vue de Francois de Ravignan, Denis Clerc et Alain
Lipietz. Deux autres articles completeront ce dossier SEL dans le
numero 211 de decembre 1996.
h - Coordination of LETS:
To solve the problems which arise within LETS, a national group
meets regularly. Information on foreign groups is also exchanged. The
meetings also aim to help others who wish to start a LETS. Edition 210
of "Silence" of November 1996 should be read which for points of view
on LETS of Francois de Ravignan, Denis Clerc and Alain Lipietz. Two
other articles complete the LETS file in number 211 of December 1996.

4 - LETS GROUPES EN ACTIVITE
Voici la derniere liste des Sels a jour pour le debut de 1998. Il peut
se creer d'autres Sels dans le zones ou ils sont encore absent, se
renseigner aupres de la coordination nationale. Si il n'y a pas de Sel
existant ou en formation dans votre zone vous pouvez envisager de vous
lancer dans la creation d'un nouveau groupe. La liste qui suit montre
la variete et l'originalite des noms utilises pour les Sels et pour
les unites de mesure des echanges (par exemple: des copeaux, des
gouttes d'eau, des sourires, du soleil...).

4 - ACTIVE LETS GROUPS:
This is the list of LETS to date for the start of 1998. Other
LETS may have been created in some zones where there aren't any so
far and can be found by contacting the national coordination. If there
are no LETS in your zone or being formed, you can start a new group.
The following list shows the variety and originality of the names used
by the LETS and for the exchange units of measurement (for example:
wood shavings, drops of water, smiles, sunlight...).

5 - INITIATIVES EN SEL:

Organisation d'un espace vacances actives conviviales en SEL (en
juillet aout), reserve aux membresdes SEL de France. Les paiements se
feront en "unites de sel", pour les repas, les stages, les
speectacles... Vous poucez proposer des animations, d'amenager les
lieux, de vous occuper de l'intendance... en echange. En juillet
1996, il etait prevu des activities artistiques et de developement
personnel, et en aout le tournage d'un film video. Droit d'entree: 60

Collectif qui apres avoir experimente le systeme SEL s'est pose, comme
d'autres, la question essentielle de la valeur de la monnaie fictive:
pourquoi l'heure de travaile d'un agriculteur ne serait-elle pas payee
au meme niveau que celle d'un dentiste, meme en monnaie fictif? Et ce
collectif essaie de modifier le fonctionnement du SEl en proposant le
principe "une heure egale une heure."

A group that experimented with the LETSystem and asked, like
others, the essential question of the value of the imaginary money:
Why shouldn't the hour worked by the farmer not be paid at the same
rate as that of the dentist, even in imaginary money? And this group
is trying to modify the operation of LETS by proposing the principle
that "one hour equals one hour."
JCT: L'edition Silence sur le SEL que j'ai mentionne dans mon
rapport #5 a l'article sur "Robert Owen et les billets de travail
(1827-1834) par Serge Dupuis qui explique pourquoi les systemes qui
estime tout travaille egalement ne sont pas attrayantes a ceux qui
sont plus efficaces, la raison que son systeme a tombe.
JCT: The Silence edition on LETS mentioned in Report #5 has a
story about "Robert Owen and work tickets (1827-1834) by Serge Dupuis
which explains why systems why valuing work equally does not appeal to
more efficient producers, the reason his system broke down.

Le passage en justice de trois membres du Sel Pyreneen, loin
d'ebranler ce systeme, a cree de nouvelles solidarites entre les
membres de ces reseaux et un afflux de demandes pour developper de
nouveaux Sel.

Le respect de la justice interdit de commenter ses jugements. Mais il
n'est pas interdit de sourire de la justice quand ses jugements
ridiculisent ceux qui la rendent... Par exemple, la condamnation a
2000 francs d'amende avec sursis que le tribunal de Grande Instance de
Foix vient d'infliger, a la demande des professionnels ariegeois du
batiment, a deux membres du Systeme d'echange local (SEL) pyreneen,
qu'elle a juge coupables de travail clandestin pour avoir repare le
toit d'une voisine en echange de quelques legumes (Journal Le Monde du
8.1.98), prendra assurement une place de choix dans le grand betisier
des anachronismes judiciaires.
Respect for justice prohibits comments on judgments. But it is
not prohibited to smile at justice when its judgments make those who
handed them down look ridiculous... For example, the conviction and
suspended sentence of a 2000 franc fine that the High Court of Foix
just handed down, pursuant to the demand of the Professional Builders'
Association of Ariege, against two members of the Pyrenee LETS local
exchange system, which found them guilty of clandestine work for
having repaired a lady neighbor's roof in exchange for some vegetables
(Le Monde 8.1.98) will surely take a choice place in the great
idiocies of judicial anachronisms.
Il est d'ailleurs dommage qu'Arte ait ete, jusqu'a present, la seule
chaine de television a mesurer la porte internationale de cette
decision a laquelle la chaine franco-allemande a consacre jeudi soir,
l'essentiel de son journal de 19h30. Car il y a la de quoi illustrer a
merveille, pour l'edification des generations futures, la difficulte
chronique de la justice a vivre avec son temps. Les magistrats en
cause beneficient, certes, tout comme les plaignants, de circonstances
attenuantes. A premiere vue, le fonctionnement de ces reseaux
d'entraide qui remplacnet l'argent par le troc, et au sein desquels on
peut echanger des services contre des biens, la reparation d'un
robinet contre un kilo de patates, la refection d'un mur contre un
cochon, ou une lecon de musique contre un bocal de champignons, semble
proceder de pratiques moyenageuses remises au gout du jour par de
singuliers utopistes.
It's also unfortunate that Arte, so far, has been the only
television network to measure the international scope of this decision
to which the franco-german network devoted its Thursday night 19h30
show. Because there is there much to illustrate the astonishment, for
the edification of future generations, the chronic difficulty of the
Justice system to stay with the times. The magistrates benefit, like
the complainants, of attenuating circumstances. At first glance, the
operation of these self-help groups which replace money by barter, and
in which one can exchange services for goods, the repair of a faucet
for a kilo of potatoes, the repair of a wall for a pig, or a music
lesson for some mushrooms, seem to be middle-age practices used today
by some singular utopians.
La transparence qui caraterise ces echanges et la philosophie qui
inspire ces communautes se traduisent par l'emergence de micro-
societes paralleles dont les normes echappent a l'entendement de la
societe dominante parce qu'elles se fondent sur d'autres valeurs que
les valeurs marchandes. Il en resulte donc, c'est vrai, en cas de
contentieux, des situations de vide juridique. Mais si, aujourd'hui,
ces systemes d'echange se developpent partout en Europe, et pas
seulement dans les campagnes, cela signifie qu'ils repondent a des
besoins en remplissant un autre vide: "Ils sont une parade contre la
crise pour les gens sans argent" souligne le sociologue Smain Laacher.
"Ils mettent une goutte d'huile dans les rouages de notre societe de
consommation", ajoutait jeudi soir la presentatrice du journal d'Arte.
Elle concluait en souhaitant que l'Union Europeenne reconnaisse vite
leur utilite publique. Bonne idee! Ces bricoleurs de solidarite sont
en effet, pour l'instant, sur le terrain, les seuls a batire l'Europe
sociale.

philosophy that inspires these communities translate into the
emergence of parallel micro-societies whose norms escape the
understanding of the dominant society because they're based on values
other than market values. The result in case of disputes, it's true,
are situations of judicial vacuum. But if, today, these exchange
systems are developing all around Europe, and not only in the
countryside, it means they're responding to needs by filling another
vacuum: "They are a parade against the crisis for people without
money" underlines sociologist Smain Laacher. "They add a drop of oil
in the cogs of consumption society", added the Arte Journal hostess on
Thursday night. She concluded by wishing that the European Union
quickly recognize their public utility. Good idea! These handymen of
solidarity are in effect, for now, on the ground, the only ones to
build a social Europe.

En revivifiant l'idee de lien social au sein de petits groupes locaux,
en ravivant la notion do fraternite, nous ne faison rien d'autre que
de realiser une ecole de solidarite et de democratie. Qui pourrait
s'en plaindre? Surtout pas l'Etat qui sait le prix que lui coute une
carence de lien social (violence, solitude, deprime et maladie). Sans
fraternite, pas de democratie. Cette nouvelle jurisprudence est la
porte ouverte a des milliers de proces a venir visant les SEL! Il
faudrait allors aller plus loin en condamnant les "Restos du Coeur"'
qui font concurrence aux epiciers, la Croix-Rouge qui fait concurrence
aux ambulanciers... Alors que les SEL existent depuis vingt ans, dans
de nombreux de pays, il est bon de noter que le pays des Droits de
l'Homme est le seul, a ce jour, a s'etre permis de condamner
l'entraide. Les sans-culottes peuvent aller se rhabiller.

By reviving the idea of the social link in the midst of small
local groups, by rekindling the notion of fraternity, we do nothing
more than realize a school of solidarity and democracy. Who can
complain? Certainly not the state which knows the costs of the rupture
of social links (violence, solitude, depression and sickness). Without
fraternity, there's no democracy. This new jurisprudence opens the
door to thousands of upcoming cases aimed at LETS. Then they could go
even further by condemning the "Restos of the Heart" which compete
with grocers, the Red Cross which competes with ambulances... Since
LETS have existed for 20 years in many countries, it should be noted
that the country of the "Rights of Man" is the only one, to date, to
have permitted itself to condemn self-help. These "no-pants" people
can go get dressed.
JCT: C'est la premiere fois que j'entends parler d'un SEL qui a
ete entraine en court. Je me demande si il y a eu un appel et ce qui
est arrive. Mais le reporteur laisse pas de doute qu'il trouve la
chose une betise.
JCT: This is the first case I've heard of where LETS has been
objected to in the courts. I wonder if there was an appeal and what
happened. But the reporter leaves no doubt as to the silliness of the
whole thing.
